District Attorney on possible charges over fatal shooting on Alec Baldwin movie: ‘All options are on the table’

The Santa Fe District Attorney hasn’t ruled out laying charges over the accidental fatal shooting of cinematographer Halyna Hutchins as Rust actor and producer Alec Baldwin was rehearsing a scene.

DA Mary Carmack-Altwies and Santa Fe County Sheriff Adan Mendoza held a briefing this morning (3am AEDT), six days after the actor accidentally shot and killed Hutchins and injured director Joel Souza during a rehearsal on the set of his film in New Mexico.

Authorities say Baldwin fired a vintage long colt revolver, loaded with a suspected live lead round in the accidental fatal shooting last week.

While the investigation remains on-going, they say it’s “too early to comment on charges at this point” but said they would be filed if warranted.

“All options are on the table at this point,” Carmack-Altwies told reporters, saying no-one had been “ruled out”.

“I am not commenting on charges — whether they will be filed or not, or on whom — so, the answer is, we can not answer that question yet until we complete a more thorough investigation.”

No one has been charged over the incident but the DA says “no-one has been ruled out at this point”.

Carmack-Altwies described “a very complex case”, with no precedent for an incident where one person may have fired the gun after another person loaded or checked it.

“We can’t say it was negligence by whom, how many people were involved,” she said.

Mendoza said items had been sent to the FBI crime lab in Virginia for analysis and authorities were awaiting a ballistics report to determine if a lead projectile retrieved from director Joel Souza’s shoulder was fired from Baldwin’s firearm.

“It’s a suspected live round that was fired but it did fire from the weapon and it did cause injury. That would lead us to believe it was a live round,” he said.

Police have secured 600 items of evidence, including three firearms and 500 rounds of ammunition — containing blanks, dummy rounds and what they suspect are live rounds.

“We’re going to determine how those got there, why they were there, because they shouldn’t have been there,” Mendoza said about what they believe to be additional live rounds found on set.

However, Mendoza confirmed there is “no footage of the actual incident”.

The sheriff said Baldwin had been cooperative in the investigation.

“He’s obviously the person that fired the weapon,” Mendoza said.

“Right now, he is an active part of this investigation.”

The sheriff didn’t given a timeline for the investigation, saying the team was “working diligently to wrap this up thoroughly and get it to the DA’s office for review” and stressing there were more interviews to be done and crime lab results to wait for.

Baldwin, 63, serves as a co-producer of Rust, a Western film set in 1880s Kansas, and plays an outlaw grandfather of a 13-year-old boy convicted of an accidental killing. Production at the Bonanza Creek Ranch, located south of Santa Fe, has been halted.

Baldwin has called it a “tragic accident” and, like other cast and crew, is cooperating with police.

The film’s producers have hired the law firm Jenner & Block to investigate the shooting. In a letter sent to cast and crew on Tuesday night, the film’s production team said Jenner “will have full discretion about who to interview and any conclusions they draw.”

Baldwin was drawing a revolver across his body and pointing it at a camera while rehearsing when the weapon fired, according to a sheriff’s department affidavit released on Sunday.

Before the incident, camera operators had walked off the set to protest working conditions, according to the affidavit.
